Brief of the Hemphill Case

1. The Initial Conflict: Evan Hemphill’s Experience as a Student-Athlete. Evan Hemphill, a student at Indian Creek School (ICS), faced verbal and emotional abuse from his basketball coach, Jimmy Little. The coach made derogatory comments about Evan's performance, stating that he was "worthless" and should not be part of the team. This abusive behavior came to a head during a public confrontation at Capitol One Arena in Washington, D.C., where Coach Little humiliated Evan in front of his peers and spectators. Following the incident, Evan no longer felt safe and had to avoid traveling with the coach. Despite Evan and his father's efforts to address the mistreatment with the school administration, no meaningful action was taken.

2. Retaliation and Retaliatory Actions: After Evan and his father, Eric Hemphill, began speaking up and filing formal complaints, Indian Creek School launched a campaign of retaliation. Evan was stripped of his senior privileges, including participation in prom, the senior dinner, and his graduation walk. Additionally, Eric, a long-time employee at ICS, was unfairly targeted at work, leading to the premature termination of the school's contract with SAGE Dining, his employer. This retaliation escalated after Evan and Eric filed legal actions, showing a clear pattern of retribution from ICS, designed to silence them.

3. Allegations of Negligence and Child Endangerment: The Hemphill case reveals deeper issues within the Indian Creek School system, particularly with regards to student safety and welfare. The lawsuit alleges that ICS failed to address and report sexual assault incidents properly, neglected its responsibility to provide safe transportation by allowing unqualified, drug-dependent drivers to operate buses, and mishandled the welfare of minors by failing to notify authorities of wrongdoing. Specific examples include Evan being forced to share a room with minors at a tournament in Salisbury, Maryland, and other instances where school officials, including Rachel Barr and Booth Kyle, ignored mandatory reporting duties.

4. Breach of Contract: Eric Hemphill, as an employee of SAGE Dining Services, suffered directly when ICS prematurely terminated its contract with SAGE, even though three years remained on the contract. This breach not only cost Eric his position but also disrupted the livelihoods of his team,. The breach was part of ICS’s larger effort to retaliate against the Hemphills after Evan filed his lawsuit. It is alleged that the contract termination was unlawful and done in bad faith, contributing to further financial and emotional harm to the Hemphill family. The school has entered into a repayment plan with SAGE dining as a result of the breach with them,

5. Defamation and Legal Battles: In response to the Hemphills' complaints and lawsuits, ICS and its attorneys, including David Dorey, filed a defamation suit against Evan and Eric. This defamation suit lacked merit and was intended to intimidate the Hemphills into silence. The Hemphills argued that the statements made about ICS were either truthful or protected under First Amendment rights, as they were part of the legal proceedings. They further argued that the defamation suit was a clear continuation of the retaliatory actions taken by the school and its administration.

6. RICO and Fraud Allegations: The Hemphills introduced allegations of violations under the state RICO (Racketeer Influenced and Corrupt Organizations) statutes, accusing Indian Creek School of engaging in a pattern of criminal behavior. This includes covering up sexual misconduct, fraudulently obtaining daycare licenses, and endangering students through improper practices. These claims further assert that ICS’s actions constituted an ongoing criminal enterprise designed to protect its reputation and financial interests at the expense of student welfare and parental rights. The Hemphills have sought to hold the school accountable not only for civil wrongs but also for these alleged criminal violations.
