Indian Creek School Faces Setbacks: A Legal Battle They Can’t Escape

In a series of stinging setbacks, Indian Creek School (ICS) has faced significant losses in the ongoing legal battle against the Hemphills, a father and son duo representing themselves as pro se defendants. Despite its numerous attempts to undermine the judicial process, ICS is steadily losing ground as the legal case against them continues to unfold.
In its latest move, ICS attempted to have a critical blog shut down—one that has persistently exposed the school’s alleged misconduct. This attempt failed, and the blog remains live, shedding light on allegations against the school’s leadership, its legal counsel, and its administrative practices.
Most recently, the court denied ICS’s motion for summary judgment, signaling that the Hemphills’ case will proceed to be heard in full. This decision is not merely procedural but indicates the court’s recognition of the validity of the Hemphills’ claims. The allegations include negligence, misconduct, and breaches of duty under the Racketeer Influenced and Corrupt Organizations (RICO) Act—a significant and unusual charge against an educational institution.
Adding to ICS’s challenges, their legal counsel, David Dorey of Liff Walsh, has come under scrutiny for allegedly being too deeply entangled in the school’s controversial practices. The Hemphills are pushing to have Dorey removed from the case, claiming his involvement has crossed the line from legal representation to alleged co-conspirator in ICS’s tactics of delay and intimidation. The situation mirrors the notorious case of John Gotti, the Gambino crime family boss, whose own attorney, Bruce Cutler, was disqualified for being too closely involved in Gotti’s RICO case.
With each new development, it appears that ICS’s troubles may only be beginning. The stakes for the school are high; if the Hemphills succeed in their claims, ICS could be exposed to criminal as well as federal charges, opening the door to further scrutiny. Already, the Hemphills' case has highlighted serious questions about ICS’s conduct and the leadership’s approach to handling issues within the school community.
